NEWS: CHristian Louboutin Looses to YSL


This is the news making the rounds at the moment in the the fashion world, as Christian Louboutin lost his case against Yves Saint Laurent in regard to his signature red soles. The designers went back and forth in an entertaining case about whether YSL should have the right to use red soles, a staple on every Christian Louboutin shoe and a defining aspect of the brand.
Today, Judge Victor Marrero ruled that although Louboutin’s red soles are recognized as his signature by the public, he has no trademark protection.

Here is his ruling via The Cut Blog:
Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection, even if it has gained enough public recognition in the market to have acquired secondary meaning.
